New Posting Requirement For All Employers: USERRA Notice of Rights and Benefits
On December 10, 2004, Congress enacted the Veterans Benefits Improvement Act which imposes, among other responsibilities, new posting duties to employers. The Act mandates employers to provide notice to all persons in regards to the rights and benefits under the Uniformed Services Employment and Reemployment Rights Act known as “USERRA.” USERRA, one of few federal employment laws that applies to all employers regardless of their size or number of employees, provides benefits, including reemployment rights and discrimination protection, to employees and applicants that participate voluntarily in all branches of the military or their reserves. In order for employers to comply with the new posting obligation they can post a notice in poster format in a prominent place where employees customarily check for employment related information. On May 3, 2005, the U.S. Department of Labor made available to employers a poster format notice which can be downloaded at www.dol.gov/vets/program/userra/poster.pdf. Remember, posting requirements such as anti-discrimination policies, wage and hours information and this new USERRA posting, are essential for Equal Employment Opportunity compliance purposes.
